Review
Review of a previous edition:
‘One of the book’s great strengths is its clear exposition of some very difficult areas of the law, moving seamlessly from points that puzzle students to points that puzzle practitioners. Other strengths are the breadth of its approach, the fact that it is extremely up to date, the freshness and vividness of its approach and its willingness to place equity in a wider context … The student will enjoy a clear, lively and challenging account of the subject matter. The practitioner will find the book well worth consulting for its clear exposition of the basic principles and of their application in difficult areas.’ - New Law Journal

A fascinating and subtle area of law...
By Phillip Taylor MBE
A FASCINATING AND SUBTLE AREA OF LAW AND A MODERN IT APPROACH TO STUDY FOR STUDENTS & TEACHERS
An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers
Professor Alastair Hudson and his publishers, Routledge, have embarked on a most courageous adventure when explaining how the law of equity and trusts operate in England and Wales with this seventh edition which breaks new teaching ground for lawyers.
We’ve been particularly impressed by the link now established between the written word in this excellent edition and its companion website which offers a different approach to studying equity for the 21st century.
In addition, there are a series of over 50 short podcasts available for those who want them, and an introduction from Hudson to describe the complexity of the subject matter which many students find difficult to grasp at first. For many, this facility will give a new impetus for those who find this area of law very difficult to understand.
So, “Equity and Trusts” gives a refreshing new way to study which will be of great benefit to distance learners who cannot attend lectures. Hudson presents his points brilliantly with the lectures, the brief video introduction and the specific documentaries which accompany the text in a way we have not seen before with this subject and are to be commended.
What we have here is a new direction for both teaching and studying in a most difficult area of law with the merging of the textual matter and visual presentation which brings to life the concepts of trusts and how equitable principles work.
In over 1,300 pages, Alastair Hudson has written an epic account of this fascinating and subtle area of law (his words) for the academic community. Do read the Preface in detail before you start reading the book. The significance of Hogarth’s picture on the front cover – “Marriage a la Mode- Tete a Tete” is explained and without giving too much away it shows the possible after-effects of a trust on the lives of a young couple so do read on!
Hudson also explains how he has structured the book so we feel the reader will get a better understanding of what this book is about. One point always worth considering is the case law authority citations.
To facilitate a greater understanding of the more difficult equitable concepts, the website is updated for newer cases which offer the human face to what, for many, is a bit of a stuffy and technical substantive law area.
Hudson’s aims are two folds and he achieves them: to explain the law of trusts in an accessible way and to address all the major academic debates that currently surround the complex principles.
The beauty of the text is the easy-to-understand examples used from real life and what Hudson describes as his ‘cognitive reinforcement’ teaching technique which we believe will be of great benefit to many.
Hudson’s conclusion is that there is ‘something remarkably humane’, in the development of equity. Yes, and this comes through with a great new approach to the subject which is a standard bearer of social justice for 21st century.
